This really seems moving now. This may be the best time for the CIR to get passed in Senate. Conference may be different ball game but right now momentum is picking up and we (IV) has to do one last effort for our amendments.
Bush administration seems finally pushing hard on CIR:

Hi all,
Please help me with the following questions.
I am planning to apply for h1b transfer in the near future but with a paystub that is having salary lesser than the usual one. Is that advisable to do premium processing in this case?
I am looking for the premium processing option as I might have to travel outside USA before I could know about the result(approval or rejection) so I assumed that I can know the result through premium processing, travel without any problem and can get it stamped too.
Or is it fine to travel when I have applied for the transfer?I have my company A visa(which I got last year) stamped in my passport.
please let me know your thoughts
Regards

Gap in employment and porting priority date:
What if there is a gap of employment between leaving the previous employer who made the initial green card application under EB3 and joining the new employer who is willing to make a new application under EB2.
I-140 is approved, I-485 was pending for more than six months when the employee left the first company and has had a gap in employment for a few months. The employee has joined the new company using EAD. I-140 has not been revoked.
Would applying for the green card under EB-2 and trying to port the EB-3 priority date cause any complications given the gap in employment. The new job satisfies the same or similar job requirement with a 50% bump in salary and meets the EB-2 requirements. Would really appreciate your insight on the risks to be aware of if any due to the gap in employment. Thanks!

hello, I am in a F1 status for about 3 years, I have been working and filing taxes. I am going to get married to a USC and apply for a green card through it. I want to know if I can have any problem in the aplication since I've been working without authorization.
Once you entered legally you should be able to get permanent residence even if you worked without authorization. Please see this blog post: Law Office of Elaine Martin - immigration news: My spouse is "illegal" - what can we do? (http://martinvisalaw.blogspot.com/2009/03/my-spouse-is-illegal-what-can-we-do.html).
Second in concern to the affidavit support how much should I show and who has to fill these forms since my future wife is unemployed.
Another common querstion so I blogged about this also: Law Office of Elaine Martin - immigration news: affidavit of support (http://martinvisalaw.blogspot.com/search/label/affidavit%20of%20support)
Third in case my wife file for bankruptcy in the future that could affect me and if it does how can avoid this. By the way I live in florida.
This is not an immigration question. You should check with a family or bankruptcy lawyer in Florida.

Guess you can reschedule it once but dont miss the next one.
read the fp thread you will get lot of inputs.
Also regarding Travel :
are the receipts good enough for international travel or we have to wait for the AP document and then only travel
Assuming we are using the AP at the POE and not the H1
thanks

Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last for Advance parole and travelled till it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does the July 07 filers need to send the cheque for $305
Should we also include Biometric fee of $80?
And how much time is it taking these days for AP/
Thanks in advance

I am in the exact same situation. I have already filed I-140/I-485 concurrently with the substituted labor. Now the dates are current I am filling another I-485 with my approved I-140. There is nothing wrong in what we are doing, as long we explain about the earlier filling and clarify the motive of the second filling. Eventually we should withdraw one of the two based on the outcome of substituted labor/I-140.

i have read some place in this forum that as long as you maintain your full time primary job you are entitled to use your ead for other smaller assignments without losing your H1 status. But then again I am not a lawyer just sharing what I have read.

Thanks for your replies.
Do you know what is a common practice of USCIS in case they don't find our reply to such RFE good enough? Do they follow up with another RFE or just deny I140? I'm trying to figure out how much time will I have to pack my stuff if things go really bad :).

My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?
We took our 17 month old daughter with us. You should not have a problem with that.
BTW, The only problem we had was that our daughter was scared of the tough looking security guy and she started crying as soon as she saw him and we had a hard time consoling her :)

Hello,
Anyone who received their Advance Parole Approvals, from NSC, who filed their I-485/AP etc on July 2nd?
Thanks.
Is there a time-frame after which one can contact the USCIS office for advance parole (like the 90 day time-period for the EAD card)?

Guys:
I know this has been asked gazillion times but jsut wanted to make sure I got it right.
On uscis website for my I-485 it says " On June 9th we recieved you application and ........so forth.
The date when this is done is June 13th as seen on the LUD.
So my understanding is that my 6 months period for me to knick in the AC21 rule would be Dec'9th.
Is this correct ??
Thanks

Thanks to all the enthusiastic members who attended the call today(Feb 26th). The number of people who attended the call were far more than what we had expected. We hope you are now more convinced about Immigration Voice and it's cause.
As explained in the call, we do need more people to come forward and help us in many of the teams that we have. If you would like to work in any of the following teams, please send an email to the email id listed next to it.
1) Membership - jay@immigrationvoice.org
2) Meet the lawmakers - pratik@immigrationvoice.org , anurag@immigrationvoice.org
3) Publicity & Media - sunil@immigrationvoice.org
4) Liaison - aman@immigrationvoice.org , shilpa@immigrationvoice.org
Given the response that we had today, we will try to make this as a regular feature of Immigration Voice. And definitely with a better conference calling system.
Please let us know of your feedback here about the call and Thanks once again.
