I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

Hi,
I'm in H1B visa and my visa was valid until 26th October , 2012. Recently, I went Bangladesh and US embassy stamped visa until October 23, 2011. When I returned US, Immigration office issued me I-94 validity until September 23, 2011. Now how long I can stay in US?? Do I need to apply for H1B visa extension or I will go to Canada or Mexico to apply for new visa or if I go to Canada or Mexico and return back, they will issue me a new I-94 until Sep/Oct 2012. Any one please suggest what should I do?

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?
The attorneys have a login when they file the PERM electronically and only they can track or the employer can track it. As far as i know it is not open to public.

Hello All,
I applied EAD for my wife in Dec Last Week. Case is still pending with USCIS. I have to move to a different state due to job change. I have put a forwarding adress with USPS. All my mail are getting forwarded.
My question is if EAD is approved will it also get forwarded to my new address as other mail or do i need to submit a change of address with USCIS.
Did any one faced this situatin before? Please advice and share your experiences.

I'm in the same boat...765 checks not cashed yet, rest got cashed on 9/20 and got the receipt numbers for 485/AP.
But still waiting on 765(EAD) cehcks to be cashed and receipt number.

On page 7 of the Instructions for Form I765, under RENEWAL EAD, it is mentioned that no filing fee is required if we are applying under the category (c)(9) or (c)(16) Adjustment applicant who applied after July 30, 2007.
I applied in the 2nd week of August 2007 (but it was still in the July 2007 fiasco). So do I need to send application fee when I send my I765 application for renewal??

We are planning to register a LLC and run the franchise on the company. Let me know if I have to take any precautions before buying the franchise..
Also let me know if my friend can be my partner on H1.b..
You can own and work for your LLC. Your H1b friend can be a partner, but he cannot work for the LLC, he can have his share of profits though. You need to confirm this with a lawyer before you register your LLC.

Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
Any suggestions are most welcome. Thanks in advance.

Short answer: No.
However, that said, you could have multiple H1 visas and work full-time for one and part-time for the other, as long as the first one doesn't have a problem with it :-)
If you get paid for work in the home country, there may be complications. One being that you'll still be taxed in the US. Consult a good Immigration attorney and a good CPA before doing anything like this.

I had applied AP for my daughter (10 years old). I have read that the Biometrics are required only for 14 years and older. In her case she got I797 with an appointment in late June for Finger Printing (obliviously we had tickets to goto India before that date :-) . What can be done to pre pone the appointment and get the AP at the earliest.
