    Yes US Post Doc (without US MS or PhD) might not qualify under SKIL. But on the other had, a post doc might have enough publications and such under his/her belt to try to go for EB1.

    Post doc is a position not a US educational qualification and hence not a benefitiary of SKIL bill. The SKIL bill included US Master's and Ph.D's.
    With your US MS you should not have any problem. Would require 3 years work experience to allow one to self adjust. We will need to wait and see what happens when it is introduced again in the new congress.

    I second this post.



    My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
    Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
    Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.

    All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

    Those who want to practice freedom of speech are free to leave this website and organization and join someone else or start their own website or forum.

    If you dont like the moderation or banning or censorship policy, please leave and dont even bother threatening us that you are leaving.

    What's the worst that could happen?

    Everyone will leave? This organization will be shut down?

    Well if that's the case, then so be it.

    But we are not going to be spending 5 hours a day reasoning with hecklers and keep deleting and moderating posts that are racist, insulting to certain groups or damaging this organization. I would rather save my time by banning such people completely instead of reasoning with them for the sake of "Freedom of Speech".

    As an admin and moderator, if its in the interest of this organization to moderate posts, then it will be a priority over the practice of "Freedom of Speech" or "First amendment rights".

    And one more thing: The first amendment protects freedom of speech and expression for the individual AGAINST the GOVERNMENT. Not non-government entities. It says that the Government cannot take away that right from you and congress cannot pass such laws to ban freedom of speech. It applies to public and government domain. Not anywhere else. Immigration Voice is not a Government body. Before preaching constitutional law to everyone and engaging in "Freedom of Speech" grandstanding, please do a little research of how the first amendment works and where it applies.

    Anybody has this situation?

    My case was sent by my attorney June 29th (current July bulletin) USPS certified mail.

    As per USPS online tracking record it was delivered July 2nd 12.45 PM.



    No receipt yet. So far sounds okay.



    But I got the copy of actual delivery receipt stamped by F.Heinauer (Director NSC USCIS) with the date 062907.

    It is a stamp so some of their employee clearly has stamped it.



    Now I am confused if that’s the receipt date they are going to go with and may reject the application.

    And with this many application it may take more than AUG 17th to receive anything back.



    I am very sure it was reached on July 2nd. It was only sent June 29th afternoon.

    And USPS is telling there is no delivery can reach so fast. According to USPS the guy who might have stamped the delivery did not changed the stamp date from 0629 to 0702 since it was a weekend.



    Anybody in the same situation? Any advice?

    Congrats Man, all the best for your future, I have yet to apply for GC (i am in my 4th year of H1 B, my company said they would take care of it, and they are painfully slow, i have now been here for 7+ yrs).
    Immigration is personal choice in my opinion, i am sure it makes sense to say i am proud of my heritage/culture, but like everybody else i came here for a better life.
    The wait for GC is very very frustrating, other the other hand it is absolutely unnecessary if the Immigration authorities just put a little effort and time into resolving it, I guess that is a underlying statement about skilled Immigrants, you have to go through a lot of frustration, pain, and anxiety to be worthy of a GC. I am beginning to wonder, if all the energy (positive and negative) i am spending here to get my GC could be spent more efficiently and in a calculated manner in India (:confused:)
    I am from India, I hate corruption and bureaucracy prevalent out there, I came here for a life filled with fun and freedom(what i thought was a better life :(), i still would like to have GC, but the wait, the tension that i need to take out here, is pushing me back to thinking maybe coming here was not a good choice in the first place, my Family is in India, and a couple of my friends are still around in India , so hopefully, when i DO go back i can hang around them and have FUN.

    As one of the members said, you cannot take India out of a man, why ?, because we have 5000+ yrs of glorious documented history, a wonderful ,colorful culture, and is the home of great people, that's why !, and that culture is entrenched in our psyche. The generation of kids born to indians here is US wont/cannot/ relate to that psyche, people like us export India, but for the next generation India ceases to exist, just my 1 cent.

    Sorry if i bored you folks with rants and raves cheers !!!

    Keep this campaign going

    Hello there,
    I called of them, took me less than 15 minutes. i am sure everyone else can call too. The selfish brats who have EAD's and are acting ignorant, remember if something goes wrong you could be stuck on EAD's for another 5- 10 years. The point is, we all as a highly skilled immigrants have an obligation to help ourselves and the ones who are stuck in this limbo till we get our GC.

    You can either choose a piece of pie or take the whole cake home for your family and friends. Life is all about choices and a man is as good as his word. So give out your good word and help the others. 15 minutes that's it.

    If PD is not current, they cannot accept the application, the just have to return the applications citing the same reason. If they accept the application they have to receipt it and if they reject, then they need to have qualified reasons for it... Not having available visas is not an acceptable reason to reject the receipted applications. It goes to shelves untill visa number becomes available... Note. if they receipt, they need to process EAD/AP and work on the application like any other.

    This is my understanding..


    based on the CIS SOP, mail room receiving is different than initial processing. Just because they accepted in mail room does not mean it is accepted. The validity of the filing is determined in the initial processing; and initial processing is complete only if you receive a receipt notice or you get your packet back. If you get your packet back, this is not denial; this is rejection. Denial is when you get yor receipt notice but your 485 is denied.

    Currently, June Filers who filed mid-month are getting their receipts which means we will know our fate only probably by the end of month or even later. keep your fingers crossed.

    We are June 15th, 2007 filers. We got our APs and EADs. There have been no more updates on mine or my spouse's 485 applications. But our son's 485 application had a LUD in September and again a couple of days ago. Does that by any chance mean that our son's NC is cleared and our's is stuck ?

    Very good material jkays94.

    I am glad to see that is so much documented material out there that puts the rights of all individuals clearly regardless of immigration status.

    I wish people would come forward and participate in efforts of their choice and speak up against unfair system, thru IV or otherwise, and not be afraid of getting fired and getting deported or being a victim of prejudice by USCIS just because they posted a thread on IV, or contributed funds or met a lawmaker to petition them for pains.

    There are a lot of visitors of the site(who wont even register on this site) who have such apprehensions and doubts and posts like yours help clear those doubts and help them join this effort and strengthen our hands.

    I agree that its the lopoholes or worse - Loose enforncement that encourages these consultancy firms to keep exploiting the system.

    WHY is she backing the bill..what is her motivation? or did she just decide to do a gandhi on us all?

    When lawmakers support certain bills..its because of the interst groups that back them..not their inner calling!

    this bill is a great example. iv is the only organization that ahs pushed for it. a bunch of "non voters". our constant pushing has helped bring lawmakers to our side and even corporations taht never cared about thsi before now have it on their agenda.

    our voices count.
    we use them in many ways. each way is important in this system.

    This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.

    My suggestion - You can not play safe your whole life.

    Highly skilled immigrants (highly paid professionals too) fretting about 25 USD per month and that too for a cause which directly affects their dignity, their professional career and in the long term their quest for a happy and fulfilling life.

    Somebody also used the term 'commercialization' before even reading through IV's agenda which clearly includes the phrase 'Non profit organization'.

    Aman Kapoor invested thousands of dollars to fight for this cause in terms of money and time, and yet some people flinch in horror at the thought of contributing 25 dollars per month.

    As I have always said and will repeatedly say '10000 active and committed members are better than 25000 fence sitters/free loaders.'

    - First, it is highly unlikely that Hastert will ever, ever support CIR. That itself is a "red flag" from a post by "Red card."

    - Actions speak louder than words. If Murtha becomes the majority leader in house than Democrat agenda for 2008 presidential agenda will be Iraq not immigration. That doesn't mean no immigration reform, just not in the "lame-duck" session.

    - Lets wait for next year for any progress on immigration.

    GCS999 - excellent points! I asked someone yesterday why they even care about Hastert. He's toast, anyway.There's a very revealing article in the Washington Post today, which says that the Dems will tread cautiously, and perhaps even slowly, on immigration. And they have bigger fish to fry, the number one being Iraq. Not sure what the needless hullabaloo about the lame duck session is. People need to stop crying wolf.

    Explosive Issue Not A Top Priority For Incoming Leaders

    When election results started rolling in Tuesday, Cecilia Mu?oz said that she and other immigration advocates were "holding our breath." One by one, Republicans who had fought tooth and nail for stricter immigration laws fell, turning control of Congress over to the Democrats.

    By morning, a 700-mile Mexican border fence passed by Republicans in a pre-election gambit had fallen flat with voters. A sharply worded GOP bill that targeted illegal immigrants and spurred marches by millions of Latinos in the spring appeared likely to fade into memory.

    "I think this is the best environment we've had on the issue in quite some time," said Cassandra Q. Butts, a senior vice president for the pro-immigration Center for American Progress.

    But when it comes to immigration, things are never easy. In the days after the election, Democratic leaders surprised pro-immigration groups by not including the issue on their list of immediate priorities. Experts said the issue is so complicated, so sensitive and so explosive that it could easily blow up in the Democrats' faces and give control of Congress back to Republicans in the next election two years from now. And a number of Democrats who took a hard line on illegal immigration were also elected to Congress.

    "It's not without its challenges, for sure," said Jeanne Butterfield, executive director of the American Immigration Lawyers Association. "You've got opposition in both parties. You still have restrictionists in the Republican Party. You have Democrats who've been reluctant to move on any kind of worker program."

    Butterfield predicted that lobbyists and Democrats have less than a year to move legislation that could put some 12 million illegal immigrants on a path to legal residency, before the looming 2008 elections make a deal politically impossible. And analysts say the fate of President Bush's proposal to create a temporary worker program for 200,000 immigrants is in doubt, with labor's allies in charge.

    In recent days, advocates have been burning up the phone lines talking to one another and to try to determine whom House Minority Leader Nancy Pelosi (D-Calif.), the presumed speaker of the next Congress, will appoint to key committees, and how the new Democratically controlled Congress will approach the issue.

    Major challenges lay ahead. The Mexican border remains a sieve where an estimated 100,000 immigrants sneak into the country every year. Conservatives in the House, and some Democrats, want the border sealed with manpower, fencing and technological gadgets before they will even consider guest workers.

    Mark Krikorian, executive director of the Center for Immigration Studies, which opposes increased immigration, said Democrats should implement an enforcement program first. Anything else might be political suicide.

    "The Democrats need to get their majority reelected in the next two years," Krikorian said. "My sense is that the Democrats have grown up enough to know they can't get reelected trying to get everything they want."

    Immigration experts are on the lookout for the kind of compromises that led to the flawed immigration reform laws of 1986 and 1996. In those years, a White House and Congress split between the two parties passed watered-down laws requiring employers to check the legal status of new hires to satisfy businesses and immigration advocates. They also failed to give enforcement agencies the money, staff, technology or practical ability to do the job.

    The miscues paved the way for an explosion of illegal immigration.

    "The question is, will this just be another split-the-baby approach, such as we saw in 1986," said Robert Bonner, commissioner of U.S. Customs and Border Protection from 2003 to 2005, "or are we actually going to do something that is going to seriously achieve the objectives of controlling the border?"

    At the White House Friday, the Bush administration struck a bipartisan chord, trumpeting both border enforcement and a guest worker initiative. "The President believes a temporary guest worker program, where you will know if you're in or you're out, is going to relieve pressure on the border and also reduce the incentive for people to travel from Central America through Mexico in search of such jobs," said White House spokesman Tony Snow.

    Bush supports a proposal by Sens. John McCain (R-Ariz.) and Edward M. Kennedy (D-Mass.) to allow foreign nationals currently outside the country to work in the United States temporarily. Illegal immigrants now in the country could work too, but only if they pay a $2,000 penalty for breaking the law, pay back taxes, undergo a criminal check, learn English, take civics lessons, go to the back of the employment line and then work six years with no legal problems.

    The McCain-Kennedy bill would also strengthen the border and create a computerized system to check the legal status of workers. The Senate bill would authorize spending $400 million to expand a pilot program used by 5,000 employers to cover new hires by more than 8 million U.S. companies within 18 months.

    But some experts are skeptical. The non-partisan Migration Policy Institute has said that the pilot system is flawed, will take at least three years to implement, and will fail unless it is made much more accurate. The MPI panel, co-chaired by former congressman Lee H. Hamilton (D-Ind.) and former senator Spencer Abraham (R-Mich.) also said other steps are needed, such as producing tamper-proof Social Security or other employment ID card based on fingerprints or other unique identifying features.

    Others say thousands of immigration investigators are needed to verify legal workers and track down those who remain in the country illegally.

    James W. Ziglar, former commissioner of the Immigration and Naturalization Service, said if Congress does take up an overhaul, "the recognition that enforcement has to be of equal stature is something that will occur this time, because the lessons learned from the 1986 act are still burning very brightly in the minds of people on both sides of the debate."

    Mu?oz, a vice president at the National Council of La Raza, the nation's largest Latino civil rights group, said Democrats should move carefully ahead with a plan that satisfies both sides.

    "This notion that it's dangerous to vote to support comprehensive immigration reform I believe to be false," she said. In Arizona, she said, voters rejected anti-immigration Republicans Randy Graf and Rep. J.D. Hayworth.

    But, to show how complicated the issue is, Arizona voters also approved three referenda to make life tougher for illegal immigrants.

    Anti-immigration Rep. Tom Tancredo (R-Colo.), who was distraught after the election, believing a guest worker program was inevitable under the Democrats, now says he's changed his mind.

    "It seemed to me that it was not going to be as easy for them as I had anticipated or feared," Tancredo said. "They're not putting it out there as their number one, out-of-the-box issue."

    The more he thought about the issue, the more cloudy the future seemed.

    "I don't know," he said. A temporary guest worker program "could certainly happen. I may be just skipping past the graveyard."

    Talking about one case where a navy officer could not appear to remove condition on her Permanent Residency. She was then served a notice of intent to deny or put in deportation proceedings. I guess still 6020.
