MY wifes EAD is approved today after following the procedure that I have written today. I am hoping that mine will be approved soon.I guess the Officer did take the necessary action to bring the documnt from Storage.

All,
I'm trying to post the IV Fliers at my Alumni School.But the issue is we need a 'sign off' from Facilities dept. at school.But again, the policy depends from School to School . Some dont need that at all.So i'm in the Final Process of completing the formalities and it is very simple.Just a simple courtesy phone call to the concerned to make this happen. All the international students are potential members to join IV and contribute to our cause. So i advise all the IV members/Core Members to think out of the Box like these as we have very little time left.but i really envy the Irish Lobby who are way ahead of us.Anyways, we need to bang it out hard or our life is gonna be dormant for lots of time.

With this rule in effect from july 2nd, what happens to the cases filed before in PP but it is in pending status with an RFE.
I had received RFE on my I-140 on June 1st and replied back on June 6th but there is no update since then from USCIS.
dotn worry...this stuff normally is for any new applications only!!!

You just hit the nail hard on its head -
1. yes, our employers pay big bucks to keep us employed and guess what, that will pay for the USCIS work force to legalize the undocumented workers. Isn't it good to have 300,000 people paying 2000 dollars each every year to extend H1 - such a nice revenue stream, and a great business idea. Guess how many Ameican jobs it creates?
2. Oh btw, you keep paying SSN and Medicare like other educated workers and then if you are unlucky which a sizeable percentage is, you do not get a dime back. I hear a lot of SS going bankrupt etc., but hey, even in the worst case scenario, they talk about reducing SS, not abandoning it. So, you subsidize the older Americans but no one susidizes you when you are old.
I think some politicians actually like our problem, we will always do things legally and it is easy to screw us as we are documented - they know who we are. Some employers (not all) like it because it i a great way to tether someone for eternity in a particular job. It is a win-win situation for these politicians and employers.
But then there are other politicians who think of the long terms effects of taking advantage of legal immigrants, and they try to help our cause. And other employers who get scared that the best ad brightest will realize they have better opportunities else where and leave.
Let us see which camp wins.

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.

Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

It DOES matter what your PD is. USCIS apparently does process FIFO according to your Receipt date - BUT ONLY IF YOUR PRIORITY DATE IS CURRENT will you get a visa number assigned (i.e. approval of said greencard).
From my understanding, this is correct but if you look at , http://www..com/usa-immigration-trackers/i485-tracker1/ USCIS is approving applications everyday. I am confused because according to the August visa bulletin, all categories are "unavailable" therefore, we shouldn't be seeing any approvals. Please enlighten me on this.

The one important thing people conveniently forget about CIR : the illegal aliens will NOT be able to apply immediately for a green card. Thats pure baloney being spread by vested interests like our self-appointed "Ombudman".
If you care to read the fine print, the original CIR has clearly mandated that all legal applications pending at the time of passage must be cleared before ANY illegal alien can apply for a green card. So assume CIR gets passed into law on 30 jan 2007 (OK that was overly optimistic :) ). All family-based and employment-based petitions with a PD prior to 30 Jan 2007 must be cleared before any illegal alien is eligible to apply. Anybody who has glanced at the visa bulletin might know that retrogression in FB goes back to 1980 in some categories. So, it may well be close to 25 years before any of today's illegal aliens can apply for a visa number. I would think that is sufficient time for congress to shore up USCIS to reach the strength required to process that many applications. This is the INTENT of the original CIR, what changes in the new (posibly more liberal ? ) version and how strictly USCIS will implement it is a different ball game altogether.
Realistically, it is highly unlikely that a democratic congress or the president will entertain standalone legislation like SKIL given the chances of CIR being revived. So chances are any relief we can get has to come through a comprehensive measure like CIR.
Assuming this congress and senate would favor CIR...
