My husband got a new job now. But the new company is taking a lot of time to send him an offer. The whole process of initiating LCA and H1B transfer will take a lot of time I guess. He has asked the new company to expedite, but they said thats the fastest they can go.
He has a couple of weeks in his current company. I am afraid that the H1B transfer might get filed only after his last day in the current company. Since he has already found a job, will the USCIS be considerate to understand that even though he has found another job, of no fault of his, he will be out of status?
What is the penalty for being out of status for few days?

I like the sharpness of the first one better. Normally with water I like blurred/smooth but I think because this shot has nothing BUT water the smooth look isn't working for me.

In my case I work for startup and I'm the only one who they are sponsoring for GC (rest all are either US citizens, GC holders or contractors) and my I140 is already approved, so ability to pay is not a concern with my company.
While I have a good rapport with the CEO etc, I am nervous that they might revoke I-140 in case they have lay offs that affect me. I was looking for some articles or USCIS documents that say that there is no requirement to revoke I-140.
Its just harder to prove that there are no such requirements other than saying "look, you couldn't find anything that says you should revoke I-140, therefore don't do it". It would be more convincing if I find something more explicit that says there is no such requirement.

I am getting married in December 2007.

I am on the same boat. My case was transfered to NSC and my receipt number starts with WAC.
I am a July 2nd 2007 filer. When i spoke with an IO few days back, he told me that they will process according to the NSC processing dates even through the receipt # starts with WAC. The IO has also confirmed that even though the case has got two receipt dates (one with CSC RD and another with NSC RD), they will consider the first one (July 2nd) to process the case.

Hi,
I applied for EAD Renewal on DEC-18 2009 ( posted to Nebraska Service Center)
It has been a month I havent received any Receipt or RFE and check for fee has not been cashed
My EAD will expire on March-15th-2010
What to do in this sitiuation?
Is there any customere service No to reach ?
Do i need to reapply ? Did anybody encounter similar situation. If so please let me know what you have done

I need a little advice on sponspring my uncle vistor's visa from India
My uncle works in auto industry and I would like to nspor him for a vistor visa. His family will not be visting and he is taking care of his in-laws as well.
Does including his family members make any difference?
Also, having a different family name makes any difference in the sponsor's letter?

I received a 500$ check for apartment referral , I am planning to give the entire amount to the person who took the apartment. I was wondering if during the tax return filing I should be reporting this as an income and if yes should I be deducting the tax amount from the 500$ as I will be paying taxes on it.
Any information is appreciated.

It is a taxable income (you got a commission for a service). However such a small change in your total household income should change your tax liability very little, and usually people would not bother to withold tax before passing it on. Also if you pass it on, that will probably fall under "gift" and will have different tax codes. For a small amount, such hassles may not be worth. Of course if you get such commissions regularly, or if it a sizable part of your total income, then you need proper calculations.

I work for a Government Agency as a H1 employee, I have my EAD as well but dont use it. I am sure the attorneys made sure that its ok to hire a H1 as an employee. Now I am doing an AC21.

So it seems IMPOSSIBLE to change job from university to company since most companies won't help you apply H1B on April and wait 6 months (till Oct) to put you into work.

I think this thread is really good start. I think the inherent problem is not the fact that H1B is temporary and ppl want GC. Basic problem is ppl want the right to be able to work for who they want and they want the same for their spouses. This can be addressed by H1B reform also. But I think it will be an uphill battle because most businesses get captive employees by way of H1B visa and would be the real losers in case of a reform.

He was of the opinion that you have to always ride the wave.The gold rush of 2000 and before is gone here.It was his opinion.
I think the main reason is people have slogged here and they want to take atleast some benefit of GC.We are contributing Social Security and you will not see a single penny what you paid to Uncle Sam unless you have a GC.

Her I-485 does not need to filed before his I-485 approval. She can file for her I-485 when PD is current and maintaining valid visa status (or out of status < 180 days) at the time of filing of her I-485.
