I am desi also, but I hate these consulting companies who do that. I worked my a** off to get a full time job, never faked my resume. People in this forum who blame it on the system are as guilty as the desi companies. Come on people, who are you all kidding, can you commit a crime and balme it on society/system for it? Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

I hardly believe your story. Your written english doesn't seem like you are a H1-B guy form the other counrty unless you are from Canada. Why the f'ng game, what do you need? Now tell us another story that you are from Canada.
@snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

@poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
Seems like there are victims falling for this modus operandi time after time.

it will add to his database and track record of black marks and i am sure many more would have tried but never complained against him, makes him immune everytime someone passes without doing it as i agree they want to be safe, but i want to blow the whistle.
I need help on the procedure of documents to be submitted , please help me on that as well.

Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.
I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
This is her opinion in quotes:
"I wanted to emphasize that you do not need to obtain the H visa as long as you have an unexpired Advance Parole document to use instead. To clarify, you are then entering in parolee status but in later filing an H extension or change of employer petition, DHS will terminate the grant of parole and admit you back into H classification. Additionally, if you enter on the advance parole and work consistent with the terms of your underlying current H petition, you are not violating your status nor do you need a separate EAD work card."

Micro-payments may be a better option for some people. Do we want to disallow those contributions as well? I guess we just have to make sure that we donot deny the people who want to pay but cannot.

Just wondering how we can make this a paid site which works and where everyone wins. Here are some thoughts in the wee hours:
0) Read for Free
1) Monthly paid subscription (recurring contributors):
a) can post without restriction.
b) get important updates
2) If you don't have a monthly contribution -
a) Your first 5 posts are free
b) After that you can buy "points" to post on IV (say minimum chunk of 25 points for $50 bucks).
To post a message, it costs you a point. If you have a question, then a couple of bucks is a small amount to have your questions answered. However, without incentive people will not answer questions (because it would also cost to post responses/experiences). So, lets say I post a response to your question, then if you (or any member who posted before me) thinks that my response was useful, and adds value to that thread, can give me a "+" which adds to my chunk of points.
This way, only people who have serious queries will post their questions, and those who are confident about their answers will post a response. It will reduce noise on the website and will become a better resource of information. Unfortunately a lot of good stuff gets lost between people venting their frustration and providing incorrect advice.
Ofcourse, we can make certain threads free to post - such as the funding drive, media drive, state chapters etc.
If you really really want lots of responses to your questions, you could also sponsor a thread - say $25 bucks where anybody can post a response for free, for a limited time.
Also certain threads can be made free to post on popular demand.

I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!
Your situation confirms what I believe. They touched your file, because in the sequence of paper file receiving, your file is next. While issuing RFE, adjudicator did not even look at your PD or chargeability. When it is all clear, then perhaps they will open the page where PD and birth country are written. If at that moment in time your PD is current you will be cleared, else back to same (or some other) pending stack of files.

Indian markets are in fact more controlled (by the government) than US ones. Last few years were like "wild wild west" on the Wall street under the cloak of "free markets" theory with practically no oversight or regulation of any kind which ultimately landed us all in this hole!!
It's not a wise decision to invest in India for another few years. If a controlled market like the US experiences such short comings, you cant even imagine how things will get in India. It's going to be extremely volatile and the armageddon is just about to begin. Stay away from there.

Since you don't have faith in IV and don't want to contribute...what are you doing here? When and If IV acheives result will you then remove money from your wallet? Also, ur goals other than getting ur green card does not match with IV's goal, so stop using "we" say "i".
