This is unprecedented - NSC was doing Eb3 140's slowly and now they stopped.
NSC EB2 140 is July 5th 2007 (my friend got approval yesterday by filing in Aug 2007)
Clear your cache and then reopen browser - you should be able to see MAY 15th update.
Thanks,
Unbelievable :(
If it is any more ridiculous, it'll be funny.

Let us say USCIS has unused visas, which they want to allocate and they have moved cutoff dates to Jun, 2006 for EB2, similarly Sep 03 for EB3.
My question is, will the visa issuance would be in the order of Priority Dates? or Notification Dates? Recently there has been lot of pressure on USCIS to issue processing results based on Priority Dates, will this force USCIS to correct its ways and issue visas based on Priority Dates.
I might have digressed a little bit on the topic of predicting cutoff dates but this question is lingering among all the IV folks who would be current or already current.
USCIS procedures suggest that for preadjudicated cases, they assign visas in order of PD, which should be the case now as focus appears to be on preadjudication. However, if there are no preadjudicated cases, as seemingly was the case last year, they have no way to do it in PD sequence. In that case, they pick files case by case in sequence of receive date (not the RD on your receipt, but the date when someone entered case data, which is close to ND) which works better for USCIS (but not for us) with wide open cut off dates.

i am not sure if any one of you has tried donating blood in the US, i have, and have been refused a couple of time for reasons ranging from
you have been to india too recently, need 12 months of continued presence in the US

our records show that last year India had an outbreak of Malaria and unfortunately you mentioned that you were in India then...
right you shouldnt have travelled in the past 12 mths - otherwise its fine. i've done it a couple of times

Nola,
Thanks for clarifying. IV appreciates support from LGBT community. You have done amazing amount of work for IV in the recent past. Some of the Bay area folks still remember your leadership at 5K run at San Francisco Golden Gate. You created a decent amount of buzz by bringing along your friends all the way to California.
IV members: Having said that, I would just like to remind some IV members to be mindful of the fact that we enjoy support from diverse groups of people and it makes sense to extend reciprocal courtesy when responding to some of the posts here e.g. the UAFA bill etc.
Cheers!
g
Weldonsprings, you might be mistaken about the UAFA bill which is up for a vote on June 3, 2009. The intent of the UAFA is to allow US Citizens and permanent residents to sponsor their foreign-born partners for permanent residency by means of demonstrating a "permanent partnership". Let me re-emphasize, this bill is geared primarily for the LGBT Community of which I am a proud member, so if you are supporting this bill, my thanks to you.
[QUOTE=WeldonSprings;343823]That is correct! The bills in the house and senate coming up for discussion does not mention visa re-capture. However, Please look at the titles-don't they sound the same. The contents are different. The content of S.424 is to give permanent residents the same STATUS as US citizens so that they can sponsor their wives, parents, brothers, sisters and doggies...So an amendment is necessary. That's why I have written in the original post-

msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.
Dont worry about people who think this is an "Indian website" - even if you scream your lungs out they wont understand ;)
Besides your GC process wont stop if you wish Happy Diwali :D
Cheer up!
Happy Diwali to everyone!!!
May God bless you and your family always!
(irrespective of your nationality ;) )

Kids,
Let us talk about EB3-India category experiencing the discrimination against EB2-India. Why there are few EB3-India approvals this FY so far???????.
One of my friend with same PD as me (Jun 2004) got approved sometime in Aug/Sep 2007. His labor was pproved in a month from NH and I-485 was filed long back when dates were current for EB3 India (early 2005?).
It is for sure that there are a few EB3 approvals this FY ? I know a lot more guys with PDs in 2002 and 2003 who got approved.

Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.
USCIS doesn't stop the application process just because your PD is no longer current
This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)
I think that they did it one time mainly to use all the unused visas. I do not know whether they will continue in the same fashion of such pre-processing in future too. If not, then that is going to be a bigger wait considering the number of applications received at their end after the July visa bulletin.
Do you think that they have enough resources available to process all?

I also have a 3 year Bachelor's degree (BSc Physics) + 3 Year masters degree (MCA) from India. I would like to get it evaluated. Could you please let me know which education evaluation agency you used?
Is you bachelor and master degree in the same or related discipline? I read somewhere that the bachelors and master's will have to be in the same or related fields for it to be considered equivalent to US Masters degree.
Yes, my Bachelor and Master's are in same/related discipline. I think you can use any education evaluator but make sure that are aware of Indian Education System. We have responded to the RFE. I will post the outcome for the benefit for all.

those people are too busy on the tracker threads now
"Those people???". What do you mean by that? These are people who are trying to get permanent residency on their own right, based on the skills they have honed for years. I don't like the condescending tone of your voice. What makes you better?

maybe we need to have a counter on the main page...
which shows member strength..
don't worry, the republican minority in the house has no power whatsoever. A simple majority is what it takes to pass a bill in the house and the Dems have more than a simple majority (50% + 1).
Only the senators can call for a fillibuster.

The growing no of posts on this thread seems to indicate this as a bigger problem than was thought of. I guess many people just get in here before the marriage with the plans of settling in career and then get married
But they finally end up to take a decision on choosing one
Green Card ?
or
Spouse ?

not personal, addressing many issues.
1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.
2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.
3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.
4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.
there are various ways to contribute, money is just one of them- although very important. if you have not done this, join a state chapter and start meeting lawmakers in your area. get friends to join iv. put up fliers and posters in local grocery stores/fairs and festivals etc. there are many good examples of these activities being done successfully. in the end it's going to matter is whether we put enough effort to push over the line- whether it's today or in 2 years.
we all have a choice. please make a wise one.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.
You signature shows like
Labor approved May 06
I-140 Applied Feb 8, 2007 (Approved Sep 18, 2007)
I-485 Applied Jun 29,2007...Received Receipt on July 31, 2007
Status - Pending
but how it is possible
I-140 Applied Feb 8, 2007 (Approved Sep 18, 2007).
currently 140 processing dates around Nov/dec-06.
