I did it online on 3/21/09 and got approved for me and my wife on 3/31/09. 10 days total turn around! I was amazed to see USCIS's efficiency on cases filed online. I heard the opposite that if you file online it was taking long time. Mine was at NSC

As I am paid on an hourly basis, I am not paid while I am on bench. As a result I don't have a pay stub for a period of 3 weeks.
Will this be a big problem in the future in terms of Green card processing?

First, you should know about rights of H-1B employee. You must get paid for all times including unproductive times (knows as "bench") as well.

the meaning of backlog is to indicate that there AREN'T enough visas available to make a category current. being current means there ARE enough visas available for your category.
so in essence, someone who is current isnt considered back-logged or vice-versa.

My case is like this....
Actually I got approval notice of H1 transfer case in month of Nov 2009 for which my current employer initiated in month of Aug 2008.
During transfer case in pending status, I got an RFE in April 2009 for which my employer submitted concerned document...later I did not have any updates of my case until Aug 2009 when employer called me and told about an second RFE which was about client letter...I lost my running project job becoz of that. but my employer again submitted client letter from somewhere which I dont know.....I thought now everything is good..but I did not get approval update from USCIS/employer after that also......
After 3 months when I check case updtate on USCIS portal then I found that my case is reopened and approved. Later when I get project and asked for salary increment to employer then he told me that there is no second RFE actually he received denial notice. I was shocked and asked him why did not he tell me about that as he has not given me any RFE related document of my case so I have to belive on his words.
Now my queries with different scenarios is as follow
Q1)If I file WH4 against him for those bench
period without any newly initiated transfer (petition belongs to that employer only)...will there be any problem for me as that period was out of status (as said by my employer)?
Q2)also will it affect if I newly initiate transfer process to another employer which is suppose in pending status ?
Q3)If I have approved petition of newly initiated transfer(of another employer) but WH4 case gets denied. will it affect my approved petition?
Q4) if both H1B transfer to new employer and WH4 case against previous employer is in pending status ...and WH4 gets denied will it affect my pending transfer case?
Q5) Is it really good to file WH4 case against previous employer as soon as I start another transfer? what will be your opinion whether to file WH4 case before new H1 transfer or after when received RFE on pending new H1 Transfer case.
Appreciate if any attorney can help me in this situatation.....

Will it be better to find another Job and go EB2? My H1b started in Oct 2007.
If you qualify for EB2 then obviously go for EB2 (as its current). If you dont have a masters and have only say 2 years of experience, then instead of wasting 3 years waiting for EB2, start a GC in EB3. Once you get past I-140 the PD becomes yours. Now whenever you jump jobs and file GC again (in EB2 say) you will get the 2008 PD. So even if EB2 retrogresses in the future, you would have saved yourplace in ht equeue.

She will definitely need to have an SSN to work in the US. Without which no employer will be able to pay or is even authorized to employ someone.

Different service center case number starts with different letters.
My case is same as yours. Earlier it used to be EAC, the latest one is WAC.
You should be able to use WACXXX... for online tracking.

Respected Madam/Sir,
I have an issue with my H1B application. Please help me.
I attended my H1B interview at Mumbai Consulate on 02nd Dec 2010. At that time Officer told me that you are qualified for H1B Visa but company is not good for you. Officer convinced me to withdraw the petition.
Then they gave me one form and asked me to sign on it and write you are withdrawing the petition.
Next day I called my sponsor and told everything. But sponsor told me that he is ready to provide all the docs and few applications already approve at consulate Hyderabad.
On 20th Dec 2010, I took new appointment and went for interview. At the time of interview I told that "I withdrawn my application as per suggestions given by Visa Officer, But my sponsor had a debate with me and put forth the point that they are not violating any norms and laws, and thereby ready to provide all sorts of doc.Please reconsider my application as they offered me very challenging role".
Then Officer asked few docs about my sponsor and asked me to come directly to consulate with passport and gave me 221 G blue form.
On 5th Jan 2010, I went with my docs and Visa Officer granted me VISA and now I got the passport with VISA.
But, on 4th Jan 2010, just before one day, I got a below mail from Consulate Mumbai.
Dear Sir,
Based on the interviews and documents submitted at U.S. Consulate General Mumbai, we have returned your petition to U.S. Citizenship and Immigration Services (USCIS) for review and possible revocation. If a consular officer receives information during the interview process that was not available to the adjudicating immigration officer at the time of petition approval and that shows the beneficiary of a petition is not entitled to the accorded status, then the petition must be returned to USCIS for re-examination. Due to this requirement, consular officers returned your petition and additional supporting documents to the Kentucky Consular Center.
You may address further inquiries on this petition to the USCIS National Customer Service Center at 1-800-375-5283.
Now I am US, and Officers didnt asked anything at port of entry.
But in USCIS website, the petition status is showing that they recieved my petition from state department and they are reviewing it.
Can I get the SSN and Am I legal to stay in US. What should I do. Please let me.

I was on L1 since 2007 and in 2008 got my H1B visa done. Since I was in the US during september and october 2008, I changed my company who held my H1B as of 1st October,2008. I dont have an H1B stamp on my passport as I have not been out of the US.
It was only yesterday that I realised I had a I-797B approval notice, which from what I read yesterday, means that I have a petition approved but without I-94.
Now my L1 I-94 on my passport is valid till November 2010.
Need your help to understand if I have an issue here for the fact that I have worked with my employer who holds my H1B for the past 9 months.
If so what are the challenges that I have and the solutions for them.

Are you using "Save for web"? That removes the EXIF, use "Save as..." instead.
Yeah, I know, the pictures aren't that compelling. In both of the ground-less shots, the ground was cropped out because it was typical city stuff... houses, old buildings, roads, neighbors' yards with tons of crap in them, etc. I miss living in a more rural area. :(
My workflow (way overkill for my POS digital camera) involves performing NeatImage and then adding Adjustment Layers and saving as PSD, then duplicating the image, flattening, making final tweaks, saving as TIFF, then duplicating again, resizing, and Saving As JPEG. Guess I should simplify things a bit. ;)

My husband's employer filed for green card under EB-1 (OR). I-140 got approved, I-485 is pending. I already did my fingerprinting. My husband's is scheduled for next week. We did not get EAD or AP yet.
Meanwhile I need to travel to Europe on business. I have a valid H-1 to re-enter US. Would my AP get approved before I return to US? If so, can I still enter with my valid H-1? My husband is planning to delay his biometrics until I get back. Are there any problems with this plan? Please advise
As long as you travel on H-!, you have no problems. You do not need AP to travel as long as your H-1 is valid. If you need a visa to re-enter, your visa needs to be valid too, or you can get a new visa based on your H-1.
If you want to avoid getting your visa renewed, then you need an AP.

With the situation currently we are facing on H-1B, in my opinion congress may do some quick fix before the CIR implementation. Reforming the H-1B visa, I do not think any thing is wrong in that. In this process of reforming H-1B visa, can we incorporate our mission of at least filing I-485 without visa availability?

My wife and I were entered on AP lately and since I work for the same employer, I am still working on my H1 and am planning to extend my H1. My wife is working on EAD, can she still able to apply for H4 based on my H1? We want to have her H4 as a back-up!
