The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Labor is done via perm process and they are now centrally processed (only prevailing wage is state dependent). Your company can apply for it online and you should get a result in 3-4 wks if the case is not audited. Good Luck to you.

I do agree an aggressive lawyer who knows the system would've put me in a much better situation.
After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...

Ours is nothing compared to it - You talk of no "background checks" in Gandhis time... when people used to be beaten on their head for marching peacefully. Many of them would bleed to death. Our struggle may be inspired by Gandhiji, but we will never be able to match the sacrifices made by othose martyrs. We may be inspired by Gandhis principles, but we can never be the Gandhi.
But the least we can do to respect that great man, is to follow some of his principles (like those stated above) in to our daily lives. Is that too much to ask?
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.

A guy fresh out of college is never equivalent a guy with several years of experience in the same field. Dollar value is dropping, Rupee is rising, salaries in India are rising. If people cannot get GC in a short period of time, there would very little incentive in coming and working here. As you must be aware most H1s these days are used to outsource work to India (by Infy and others), and not to get people to work permanently here. I suggest you read the Kauffman report thoroughly to understand the situation.

I thought i wouldn't marry till i get ma GC coz i didn't wanna gal to come n rot here without a job being on H4.
but now i've gotten so freakin old waitin for the GC n still waitin that i might not get a gal to marry.:eek: :eek:
well there are always other things to do for a H4 ..
At present My wife on her H4 is pursuing her Master's degree ... I donot need to tell you that I got a deep hole in my pocket..
Also I have heard some H4 spouses doing volunteering work..
Also you can have kids and get another piece of 'work' out of the way...If anyone has more ways of making the better of the situation let me know...

o.k...I hope you are correct. but how do you explain this ..my friend with a PD in 2004 EB3 had submitted incomplete medicals for his wife as they were expecting a addition in the family ..they submitted during the fiasco with RD in july / aug 2007 ..however no RFE's so far ?? (TSC shows processing dates in end aug 2007 ..which could mean that they are processing sept cases )
Same with one of my friend - his PD is EB3 2005 India - he never received his FP as yet and is just planning to wait it out. Gets his EAd and Ap renewed regularly.

Thanks for your feedback. We dont have valid H1B stamp on the passport although we have a valid H1B approval. My wife needs to go for stamping.
My question is, Can I enter thru AP after a 4 week period whereas my wife can apply for a H1B visa at US consulate and enter using the stamp on her passport. I would be using H1B and working for GC sponsoring employer and wont use EAD during this period.
If you use AP to enter you will not be in H1B status but you will get Parolee status. If you enter using a valid h1b stamp, you will get into h1 status. Your spouse cannot get h4 stamp based on your parolee status but can get h1 stamp based on her own h1 petition.
It is also possible to be in AP status and use the H1 petition to continue working for the h1b employer. EAD is just a work authorization and is not mandatory in this case. Check this link for more information:

I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
