How about tourist visa? you can get multiple entry for 10 years, but I guess no of months you can stay in India is a question. I am applying for my son too, both of us hold Indian passport, what you guys suggest? go for OCI?

She will be in AOS Pending status after Oct 1st, 2007 due to pending I-485 application. EAD does not provide any status.
What is your status? I assume H1-B. You can file for H1 and H4 extensions.

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.

You can be paid hourly or weekly or monthly or by weekly, does not matter as long as your job is fulltime and in same or similar occupation. Hourly pay is a more convinient tool for employers to keep you as contigent worker at times it works both ways because you can get paid more if you work more hours (depends on the state I guess).
You may verify the same with lawyers and gurus.

I think u guys are getting anxious and thinking of such ways. u will need some determination to complete the MS besides ur regular work.......suppose if EB2 gets clogged suddenly next year, will u stop doing MS then?
While what you ask is valid what you need to understand is that these people have a right to get anxious and hence want to better their situation and you should not object to that. Help them if you can and if you dont want to help then dont. Let them figure their way out, Believe me they will figure out a way to do MS for less and online. Well my story isn't really as bad some of the stories described here but the last 4 years of waiting for the freaking LC to clear has pretty much screwed up my wife's career. There have been days of utter frustration, fight and bad days for us because of the "dependent" visa.
Its not like my job is great either. I am stuck in the same position for the last 5 years because of the freaking labor certification. Looks like I will be stuck for another couple of years. If I bail out now and leave for India it will be hard to find a suitable position because I have been unable to move up because of GC and at the same time my wife will have the impossible task of finding a job after 4 years of unemployment.
For this reason I am wiling to gamble at least another year or two, so that my wife can work and I can get a better job and then we can start thinking about where we really want to settle :) Gosh, never knew trying to settle in US with a GC will be so unsettling :(

Another example my ex-boss in US had. There was a homeless person in his area and he used to see him almost every day. One day he decided to do something, talked to him and asked him to sign-up with his church rehab group, get him a job etc....My ex-boss was serious but the homeless promptly rejected all the offers and instead he just wanted to remain as homeless only. He didn't even want to try....

This favours temporary workers on H1, L1 etc. An H1/L1 spouse can move to the US easily, but not that of a GC holder. If you want to bring out this "discrimination", that would mean to discontinue H4 visas, as seeminlgly it is a discrimination against a GC holder. Is that you are looking for?
EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.

The flower campaign is apparently working as far as the attention the issue is getting.
If we can manage to send at least 500-700 flowers to USCIS, that will create the kind of attention we want and it will bring the issue of retrogression again on the forefront in Washington DC.

Its very interesting to read about people?s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind?lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past? .. and especially the people in the seventh year
1. You are in your seventh year? and you loose you job?.what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave?forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist ?
2. You have home which you bought with so much pride?what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave?and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..
3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA ? all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"?to another place where they don?t even understand the language forget the culture, national anthem etc..
4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back?why because your don?t have a GC
5. Forget the Golf and Tennis you enjoy so much here ?it was all a very good dream..

You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens? the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more hard..so that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
2. All your batchmates are doing great..some of them are now sweating to be VP?s having risen by changing jobs ?. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..
Last but not the least? flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture ?and then set up a new home,,new school for kids?.why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...
We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC?

As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Just kill the time???
When cops knock out your room, handcuff your hands on the back, force you stay down at the corner , if you could keep calm and state very clearly. I can only show my respect but unfortunately I did not make it. This is my first time. :( Should be the last time either.
Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.

No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.
This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.
Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.
My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.
I feel that police and people are considerate to situation.
So, based on my experience of sevaral such things happening due to ignorance and past habits:
.... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
.... If you have any cultural example, explaining up to what level it is acceptable in your society.
You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.
This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.
Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.
My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.
I feel that police and people are considerate to situation.
So, based on my experience of sevaral such things happening due to ignorance and past habits:
.... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
.... If you have any cultural example, explaining up to what level it is acceptable in your society.
You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

The OP wanted an advise, so please give one , constructively. As far as consequences for anyone's actions they will suffer from it. There will be no escape whether in this issue or in any other issue in life.
I have noticed many posts in the recent past wherein the forum discussions degrade to personal battles real quick. The persons involved feel the need to respond to an irky post by upping the ante. Stop this game of one upmanship....

Isnt the goal of Education to make a person a better person, morally and otherwise? Is this what your education got you to? All of your Education (I am assuming you have four MS degrees, two PHd, as you have twice mine, and about 300K salary) is a total waste, if you stick up your head to support someone who does shop-lifting and have no qualms about it ( i have definitely not seen any statement to that effect from the OP, just seeking "immigration" advise). I can only think of a myriad number of reasons why you want to support this guy..maybe you yourself might have sticky hands my friend? Or maybe you are the same guy posting with two IDs and supporting your shop-lifting by such BS? I have no idea and am not interested either.
Try browsing the anti-immigrant nut websites and try answering their type-casting immigrants by the acts of few, and then you will understand what i am talking about. Till, then, probably, you can take all of your fancy-a** education, fat salary and shove it up!

You all are right that we should not divide ourselves on EB2 and EB3 basis. But it is true that there is no hope for EB3 unless the point is raised for it in IV drive. EB3 is a hopeless case. People are so frustated since they are unable to decide about their future. Let's do something for it too.
I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....
